PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the 3rd respondent in Na.Ka.No. A1/19097/2011 dated 30.06.2011, quash the same and consequently direct the respondents 2 and 3 to fix the seniority and give notional promotion and give the monetary benefits to the petitioner. ORDER
The petitioner's claim for fixation of seniority and notional promotion was rejected through the impugned order dated 30.06.2011. Challenging the same, the present writ petition has been filed.
2. The learned counsel for the petitioner submitted that when identical issue came up for consideration in W.P.No.3552 of 2011, the Hon'ble Division Bench of this Court had observed that the issue involved in this writ petition was a subject matter of https://hcservices.ecourts.gov.in/hcservices/
S.L.P.No.6980 of 2018 and therefore had granted liberty to the petitioner therein to workout his remedies in accordance with the outcome of the proceedings in the Special Leave Petition.
3. Since the petitioner herein is also similarly placed as that of the petitioner in W.P.No.3552 of 2011, this Court is of the view that a similar liberty can be granted to the present petitioner also. As such, no interference is required to the impugned order.
4. Accordingly, the Writ Petition stands closed with liberty to the petitioner to workout his remedies in accordance with the outcome of the proceedings in S.L.P.No.6980 of 2018. No costs.
