This petition has been filed to stay all further proceedings pursuant to the Judgment and Decree passed in M.C.O.P.No.2265 of 2011 dated the 7th of March 2016 on the file of the Motor Accident Claims Tribunal, (Principal District Judge) at Cuddalore in relation to the apportionment of 50% liability placed on the petitioner and 5th respondent herein being the insurer and owner of the vehicle bearing registration No.TN-02AQ-9700 (Hyundai Car). 2.The learned counsel for the petitioner/appellant seeks permission of this Court to withdraw the Civil Miscellaneous Petition and he has also made an endorsement to that effect.

3.In view of the submission and endorsement made by the learned counsel for the petitioner/appellant, this Civil Miscellaneous Petition is dismissed as withdrawn.
