O R D E R
Plaintiffs 2 to 5 in O.S.No.603 of 1999 on the file of Principal Sub Court, Erode have filed the Civil Revision Petition No.1450 of 2015 to direct the trial court to dispose of the suit within a stipulated time. Similarly, defendants 4,7,8 and 9 in O.S.No. 307 of 1999 on the file of Principal Sub Court, Erode have filed the Civil Revision Petition No.1450 of 2015 to direct the trial court to dispose of the suit within a stipulated time.
2. The learned counsel appearing for the petitioners submitted that both the suits i.e., O.S.Nos.603 of 1999 and 307 of 1999 are tried jointly by the trial court and the oral evidence of the parties have been completed. Further, the learned counsel submitted that this court by order dated 10.07.2009 had already directed the trial court to dispose of the suit in O.S.No.603 of 1999, within a period of three months and in spite of the direction given by this court, the suit in O.S.No.603 of 1999 has not yet
been disposed by the trial court.
3. In these circumstances, taking into consideration the limited prayer sought for in the Civil Revision Petitions, without expressing any opinion with regard to the merits of the case, I direct the Principal Sub Court, Erode to dispose of the suits in O.S.Nos.603 of 1999 and 307 of 1999 on merits and in accordance with law on or before 30.06.2015. The Principal Sub Judge, Erode is directed to report the disposal of the matters to the Registry of this court immediately after pronouncing the judgment. With these observations, the Civil Revision Petitions are disposed of. No costs.
