The petitioners apprehend arrest for the alleged offence under Sections 303(2), 326 of BNS, in Crime No.28 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioners illegally transported 1/4 unit of river sand without valid permission. Hence, a case has been registered against the petitioners.

3. The learned counsel for the petitioners submitted that the petitioner are innocent and that they have been falsely implicated in this case and they have not committed any offence as alleged by the prosecution. He further submitted that they are ready to abide by any conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioners.

4. Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the first petitioner has five previous cases, the second petitioner has four previous cases and the third petitioner has one previous case pending against them. Hence, he opposed to grant anticipatory bail to the petitioners.

5. I have given my anxious consideration to either side submissions.

6. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that A1 has five 5 previous cases A2 has four previous cases and A3 has one previous case pending against them. In view of such criminal antecedents of the petitioners, this Court is not inclined to enlarge the petitioners on anticipatory bail.
