Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus calling for the entire records pertaining to the Notice / order dated 09.03.2023 issued by Executive officer, (4th respondent) Arulmigu Angalamman Thirukkoil, Velipettai street, Dharmapuri Town and District and quash the same, Consequently direct the respondent herein to drop the entire proceedings with record to entire eviction proceedings pertaining to the property at Old survey No. 4/1 T.S. No. 152 / 2 Ward - C, Block 24,, Velipettai street, Dharmapuri Towna nd District and grant such other suitable orders.

ORDER

(Made by the Hon'ble Chief Justice) We have heard Mr.C.Umashankar, learned counsel for the petitioner and Mr.N.R.R.Arun Natarajan, learned Special Government Pleader assisted by Mr.K.Karthikeyan, learned Government Advocate for the respondents.

2. Learned Special Government Pleader appearing for the HR & CE Department submits that the appeal filed by the petitioner before the District Revenue Officer was dismissed on 10.04.2024.

3. Learned counsel for the petitioner submits that a civil suit is also filed, however no injunction order is operating in favour of the petitioner in the civil suit also.

4. It is submitted that the petitioner has only challenged the notice under Section 78. We are not inclined to entertain the writ petition. The petitioner may appear in the enquiry. The writ petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. (S.V.G., CJ.)
