PRAYER : Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondents to accept the second petitioner's land situated in S.F.No.577 in Vadavalli Village, Coimbatore South Taluk, Coimbatore District measuring to an extent of 1.19 1⁄2 acres in lieu of first petitioner's land situated in S.F. No. 99/B in 1/3

O R D E R

This Writ Petition has been filed for the issuance of Writ of Mandamus directing the respondents to accept the lands belonging to the uncle of the petitioners in exchange to the Panchami lands which are in possession of the petitioner .

2. Heard Mr. M.A.P.Thangavel, learned Counsel appearing for the petitioner and Mr. S.N.Parthasarathi, learned Government Advocate appearing for the respondents.

3. The petitioners do not have any legal right to seek for such exchange of lands. The petitioners, in order to escape from the consequences of occupying Panchami lands, is now offering certain lands in exchange with the lands which belongs to his uncle. This request made by the petitioner cannot be traced to any right, much less a legal right. The respondents are not bound to consider such representations.

4. This Court does not find any merits in this Writ Petition and the same is dismissed accordingly. No costs. Consequently, connected miscellaneous petitions are closed. s/d- Assistant Registrar(CS-V) True Copy Sub-Assistant Registrar bkn 2/3
