O R D E R

This writ petition has been filed seeking issuance of Writ of Certiorari calling for the records in order dated 28.01.2022 bearing No. JD/CEZO/Z-1/01/2022 passed by the first respondent and to quash it as illegal, arbitrary and unlawful.

2.The learned Senior Counsel appearing for the petitioner submitted that as against the impugned order, there is effective appeal remedy available to the petitioner before the Appellate Tribunal. Hence, this Court, without going into the merits of the case, may grant liberty to the petitioner to exhaust the appeal remedy in the manner known to law. The learned Senior Counsel further submitted that this Court may extend the order of interim stay granted by this 2/5

Court on 13.04.2022 for a period of six weeks so as to enable the petitioner to avail the appeal remedy and further submitted that the period during which this writ petition was pending before this Court may be excluded for the purpose of limitation. 3.The learned Senior Central Government Standing Counsel appearing for the respondents raise no serious objection. 4.Considering the limited request now made by the learned Senior Counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, permits the petitioner to work out the remedy before the Appellate Tribunal in the manner known to law. The order of interim stay granted by this Court on 13.04.

2022 is extended for a period of six weeks from the date of receipt of a copy of this order so as to enable the petitioner to avail the appeal remedy. The period during which the writ petition was pending before this Court is excluded for the purpose of limitation. Without insisting limitation, the Appellate Tribunal shall entertain the appeal preferred by the petitioner and decide the same on merits and in accordance with law, as expeditiously as possible. Liberty is granted to the petitioner to raise all the points before the Appellate Tribunal.

5.The writ petition is disposed of with the above observation. No costs.
