Rajagopal ...Caveator/Defendant Prayer: Original Petition has been filed under Sections 232 and 276 of the Indian Succession Act read with Order XXV Rule 5 of O.S Rules, praying for grant of Letters of Administration in respect of last Will and Testament of the deceased P.Sourirajalu. Against this petition, Caveat and supporting affidavit were filed by the Caveator. As per order of this court dated 22.06.2010 in OP.No.501 of 2009, the Original Petition has been converted into Testamentary Original Suit No.17 of 2013. JUDGMENT

When the matter came up for hearing today, the learned counsel for the plaintiffs has stated that both the parties have settled the issue out of Court. He seeks permission of this court to withdraw this suit and to refund the court fee to the second plaintiff and he has also made an endorsement in the case bundle to that effect.

2. Recording the above submission and endorsement made by the learned counsel for the plaintiffs, this Testamentary Original Suit is dismissed as settled out of Court. No costs. The Court Fee is ordered to be refunded as per law.
