.. Second Respondent/Beneficiary Appeal Suit (First Appeal)against the decree of the Additional Subordinate Court, Chengalpattu dated 28.04.2017 and made in L.A.O.P.No.75 of 2007.
Decree:This Appeal Suit coming on for hearing on this day and upon perusing the Grounds of Appeal , the order of the Lower court and the material papers in the case and upon hearing the arguments of Mr.V.Ravi, Special Government Pleader for the Appellant and of Mr.P.S.Raman, Senior Counsel for Mr.A.S.Vijay Anand for First Respondent, and Mr.Sriram, Advocate for the Second respondent and this Court while observing that the First Respondent/Claimant having withdrawn a Sum of Rs.One Crore as per order of this Court dated 21.11.2019 receipt of the same is acknowledged by the Special Government Pleader appearing for the Appellant/Referring Officer, and this Court while allowing this Appeal in part,doth order and decree as follows: i)That the value of the Land be and hereby is fixed at Rs.87,200/-(Rs.Eighty Seven Thousand Two Hundred Only) per cent, after deducting 20% towards developmental charges instead of a Sum of Rs.1,00,000/-(Rs.One Lakh Only) per cent as fixed by the Reference Court;

ii)that in other aspects the impugned order passed by the Reference Court do stand confirmed;
iii)that the Appellant herein/Referring Officer be and hereby is directed to deposit the claim amount within a period of two months from the date of receipt of a copy of this order. iv)that the First Respondent herein/claimant be and hereby is permitted to withdraw the amount now fixed by this Court based on Rs.87,200/-(Rs.Eighty Seven Thousand Two Hundred Only) per cent with accrued interest till date, lying in deposit to the credit of L.A.O.P.No.75 of 2007 on the file of the Additional Sub-Court,Chengalpet.
v)that after calculating the value per cent as indicated above in this order, the remaining amount, if any, shall be refunded to the Referring Officer(s) in accordance with law. Sd/- Assistant Registrar(CCC) //True Copy// Sub Assistant Registrar To
