ORDER : The Court Made the following order :- Petitioner, who was arrested and remanded to judicial custody on 02.03.2021 for the offence punishable under Sections 294(b), 323, 324, 506(i) and 302 of I.P.C in Crime No.38 of 2021, seek bail.

2. The case of the prosecution is that there was wordy quarrel between the petitioner and the defacto complainant's wife and the petitioner said to have assaulted the deceased on her chest and suddenly she died on the spot itself. Hence the husband of the deceased lodged a complainant against the petitioner.

3. The counsel for the petitioner submit that the petitioner had not committed any offence as alleged by the prosecution. Hence he prays for grant of bail to the petitioner.

4.The learned Additional Public Prosecutor opposed the bail application by stating that due to the act of the petitioner, the deceased died on the spot itself and the investigation is in very premature stage.

5. Considering the gravity of offence committed by the petitioner and the investigation is in pre mature stage, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
