Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents 1 and 2 to consider the petitioner's representation dated 14.11.2025 and direct the respondents 1 and 2 to issue the Call Detail Records (CDR) of Mr.Mahesh Balakrishnan's Mobile No.9677223181 from March 2024 to the current dated from the concerned service provider viz., the 3rd respondent and pass such further or other orders.

ORDER

This Writ Petition (Criminal) has been filed seeking a direction to the respondents 1 and 2 to consider the representation submitted by the petitioner dated 14.11.2025, seeking call detail records of Mahesh Balakrishnan's Mobile No.9677223181 from the month of March 2024 till the current date from the third respondent.

Heard the learned counsel appearing on either side and perused the materials available on record.

There is a dispute between the petitioner and her husband viz., Mahesh Balakrishnan. Due to the said dispute, the petitioner lodged several complaints alleging various allegations. In one such complaint, a case was

registered by the second respondent in Crime No.290 of 2025. Now, the entire investigation has been completed and the final report was filed. The same has been taken cognizance in C.C.No.108 of 2026 on the file of the Judicial Magistrate, Thiruporur and it is pending for trial. In the meanwhile, the petitioner submitted a representation seeking call detail records of her husband, viz., Mahesh Balakrishnan, to establish the allegations made against him in Crime No.290 of 2025. However, the second respondent has already completed the investigation and filed the final report, which has been taken cognizance by the Trial Court. Therefore, the request made by the petitioner seeking the call detail records cannot be accepted and the same cannot be forwarded without following the due process of law. 4.

In view of the above, the representation submitted by the petitioner cannot be considered. Thus, the writ petition lacks merit and is liable to be dismissed. Accordingly, this Writ Petition (Criminal) stands dismissed. However, the petitioner is at liberty to workout her remedy before the Family Court, if so advised. It is also brought to the notice of this Court that the Guardian Wards Original Petition is pending before the Family Court.
