Respondents Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the respondents 2 and 3 to effect an agricultural pump set connection under Thatkal TSFS Scheme to the petitioner's land in Survey No.198/2 of Erumaipatti Village, Edapadi Taluk, Salem District pursuant to the communication of the 2nd respondent bearing Ka.No.Se.PO/E.Pe/Edapadi/Tho.Nu.U.2/KO TSFS/No.115-82/17 dated 21.07.2017.

O R D E R

The petitioner seeks for a mandamus directing the 2nd and 3rd respondents to effect agricultural pump set connection under Thatkal TSFS Scheme to his land in Survey No.198/2 of Erumaipatti Village, Edapadi Taluk, Salem District.

2. Heard both sides.

Learned counsel for the petitioner submitted that the only objection raised by the 2nd respondent for not providing the electricity connection is that the petitioner is having the joint patta in respect of the property, for which, the said facilities sought for. Therefore, he submitted that the petitioner has now obtained a separate patta in respect of the very same property and therefore, there will not be any impediment for the 2nd respondent to consider the request of the petitioner.

4. Learned standing counsel appearing for 1st to 3rd respondents submitted that if the petitioner is having a separate patta, it is open to him to approach the 2nd respondent and produce the same before the authority so as to enable him to consider his request for providing service connection.

5. Considering the above stated facts and circumstances, this writ petition is disposed of by directing the petitioner to approach the 2nd respondent and produce all the necessary documents including the separate patta obtained by him in respect of the subject matter property, for which, he seeks service connection. Once, the petitioner appears and produces all the necessary documents, the 2nd respondent shall consider the same and pass appropriate orders on merits and in accordance with law within a period of two weeks from the date of production of such document. Accordingly, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
