ORDER
This criminal original petition has been filed seeking to direct the 3rd and 4th respondents not to harass the petitioner's son under the guise of enquiry or investigation.
2. When the matter was taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents, on instructions, submitted that there are three previous cases pending against the petitioner's son and that he was called only for executing a bond under Section 110 of Cr.P.C. and that the respondent police are not harassing the petitioner and her family members.
3. Such being the position, it is for the Investigating Agency to issue appropriate notice to the petitioner's son under Section 35(3) of BNSS for enquiry and on receipt of such notice, the petitioner's son shall appear for enquiry and co-operate in the investigation. It is made clear that the 2/4
petitioner and her family members shall not be harassed during the course of enquiry. If any cognizable offence is made out, the respondent Police shall register a First Information Report and proceed in accordance with law.
