A.No.1680 of 2024 and C.S.(Comm. Div.)No.82 of 2021 ABDUL QUDDHOSE.J., This application has been filed seeking leave of this Court to permit PW3, Mr.David Townsend to let in oral and documentary evidence through video conferencing since the said witness is unwell and is a senior citizen. The learned counsel for the first respondent has stated no objection for allowing this application.

Eventhough, the learned counsel for the second respondent / second defendant seeks time to file counter, this Court after giving due consideration to the reasons given in the affidavit filed in support of this application, is inclined to allow this application without any necessity for the counter by the second respondent / second defendant. Accordingly, this application is allowed as prayed for since sufficient cause has been shown. The witness Mr.David Townsend (PW3) is permitted to let in oral and documentary evidence through video conferencing as prayed for in this application.
