These applications are filed to set aside the abatement caused due to the death of the second defendant in the suit and to bring on record the proposed respondents 11 to 14 as the legal heirs of the deceased second defendant in the suit as defendants 11 to 14. 2.Considering the averments made in the affidavits filed in support of the applications and also considering the no objection expressed by the learned counsel for defendants 1 and 4, both the applications are allowed and the proposed respondents 11 to 14 are ordered to be brought on record as defendants 11 to 14 in the suit as legal representatives of the deceased second defendant. The applicant is given one week time to carry out the amendment. 3.Learned counsel for the applicant submits that the connected Second Appeal in S.A.No.84 of 2016 has already been referred to Mediation and the same is pending and therefore, the application in A.No.4749 of 2015 in C.S.No.275 of 2014 can be referred to mediation.

mmi 4.In view of the submission made by the learned counsel for the applicant, Registry is directed to list the application in A.No.4749 of 2015 in C.S.No.275 of 2014 before the Mediation and Conciliation Centre, High Court, Madras, on 07.12.2016 and the parties are directed to appear before the Mediation Centre on that day without fail.
