CRL.MP.NO.4411 OF 2023 IN CRL.RC.NO.182 OF 2023 V.SIVAGNANAM, J.

The petitioner has filed the above Criminal Revision seeking to set aside the order dated 22.12.2022 passed in Crl.M.P.No.4391/2022 by the learned Principal District and Sessions Judge, Nagapattinam and to grant interim custody of the vehicle viz., Eicher Tractor bearing Registration No.TN49-AH-1807 with Tipper to the petitioner / owner of the vehicle, in connection with the Crime No.284 of 2022 on the file of the respondent police.

This Court by its order dated 10.02.2023 in Crl.R.C.No.182 of 2023 set aside the impugned order passed by the learned Trial Judge and directed the respondent police to return the above said vehicle to the petitioner / owner of the vehicle with certain conditions including a condition that the petitioner shall execute a bond for a sum of Rs.5,00,000/- before the learned Principal District and Sessions Judge, Nagapattinam. 1/3

3. Now that, the petitioner has come up before this Court seeking to modify above said condition on the ground that the learned Trial Judge sought solvency certificate from the petitioner. The direction given by this Court to execute a bond is only for the interim custody of the vehicle and not for any other purposes and there is no circumstances warranting to modify the conditions imposed by this Court.

4. In fine, there is no merit in this Criminal Miscellaneous Petition and accordingly, the same is dismissed. 29.03.2023 TK 2/3
