O R D E R
The petitioner has come forward with this revision against his conviction for offence under Section 138 of Negotiable Instruments Act and sentence of one month simple imprisonment and to pay compensation of Rs.5000/- to the complainant.
2. The learned counsel for the petitioner has brought to the attention of this Court the letter dated 31.12.2010, sent by the respondent to the petitioner, acknowledging receipt of a sum of Rs.24,000/- from the petitioner, towards full and final settlement of dues of hire purchase availed by the petitioner from the respondent. https://hcservices.ecourts.gov.in/hcservices/
The learned counsel has also produced receipt showing deposit of compensation amount as directed by the Court below. The learned counsel for the petitioner submitted that since the petitioner has paid more than the value of the cheque amount, this Court may show mercy on him.
3. While confirming the conviction imposed on the petitioner, since the petitioner has paid money more than the cheque amount, as evidenced by the receipt issued by the respondent, the sentence is reduced to period already undergone.
