PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents 1 and 2 to alter the date of birth of the petitioner in his service record from 23.03.1963 to 01.06.1964 and permit the petitioner to retire from the service on reaching the age of superannuation, on the basis of the alteration of date of birth i.e 01.06.1964 based on the enquiry report, with all consequential monetary and service benefits and pass orders. 1/4

ORDER

This petition is filed seeking to issue a Writ of Mandamus directing the respondents 1 and 2 to alter the date of birth of the petitioner in his service record from 23.03.1963 to 01.06.1964 and permit the petitioner to retire from the service on reaching the age of superannuation, on the basis of the alteration of date of birth i.e 01.06.1964 based on the enquiry report, with all consequential monetary and service benefits and pass orders.

2.The facts of the case is that the petitioner is a retired employee of the Respondent/Board. The sum and substance of the case is that a error was crept in the service records of the petitioner, wherein his date of birth was recorded as 23.03.1963 whereas, the correct one is 01.06.1964. Regarding the said issue the petitioner has given several representation to the respondents. However, the same was not considered till date, which has given rise to this petition.

3. The learned standing counsel appearing for the respondents 2/4

produced a letter in Memo.No.012337/G.12/G.122/2019 dated 31.03.2023 wherein it is stated that they have considered the request of the petitioner and altered the date of birth as 01.06.1964 instead of 23.03.1963.

4. In view of the above it is made clear that the respondents have considered the plea of the petitioner and altered the date of birth. Hence, nothing survives for further adjudication in this petition and this petition deserves to be dismissed. Accordingly this petition is dismissed. Consequently, the connected miscellaneous petition are closed. No order as to costs.
