O R D E R

(The case has been heard through video conference) The writ petition has been filed seeking a direction directing the 1st respondent to dispose the appeal dated 27.05.2018 submitted for cancellation of patta on the file of 2nd respondent.

2. In view of the order is going to be passed in the present Writ Petition, which will not prejudice the interest of https://hcservices.ecourts.gov.in/hcservices/

the 3rd respondent, notice to the 3rd respondent is dispensed with.

3. The grievance of the petitioner is that against the order passed by the 2nd respondent cancelling the patta, the petitioner has filed an appeal before the 1st respondent and the appeal enquiry was also conducted on 01.10.2020. Thereafter, no order has been passed. Hence, the present writ petition has been filed by the petitioner.

4. The learned Government Advocate appearing for the respondents submitted that even though the enquiry was conducted thrice, the 3rd respondent did not appear. Hence, the enquiry could not be completed. Now, the enquiry is posted on 11.05.2021.

5. Considering the fact that the enquiry is pending for a long time, the 1st respondent is directed to proceed with the enquiry and pass suitable orders on merits in accordance with law after hearing the petitioner as well as 3rd respondent within a period of twelve weeks from the date of receipt of a copy of this order. Accordingly, this Writ Petition stands disposed of. No costs.
