Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records of the the 1st Respondent relating to the Impugned Order vide Application No. ALC32004647 dated 27.3.21 Regulations for Admissions to the LL.B.(Hons) Course uploaded in the website of the 2nd Respondent in so far as the eligibility criteria are concerned and quash the same as illegal arbitrary and devoid of merit and consequentially direct the Respondents to accept the application and allow the Petitioner to participate in the counselling process of the 1st respondent University to the three year LL.B Course.

O R D E R

The writ petitioner has challenged the rejection order passed by the respondent. The petitioner has applied for 3 year L.L.B. Course offered by the Tamilnadu Dr.Ambedkar Law University for the academic year 2020-2021. He was not studied 10 + 2 + 3 or 11 + 1 + 3 regular stream as stipulated by the University. According to the petitioner, the petitioner has undergone Diploma in I.T. Course. On completion of diploma course, he studied B.Tech Course. Now, he applied for 3 year L.L.B. Course. According to the petitioner, aforesaid diploma Course is equivalent to higher secondary Course. Therefore, he is eligible for admission to 3 year L.L.B. Course. The aforesaid diploma Course was not considered as equivalency Course by the Government for eligibility of 3 year L.L.B. Course. Therefore, the petitioner has filed the present writ petition.

2. The Government not only rejected the aforesaid diploma Course in the eligibility criteria for 3 year L.L.B. Course but also, no equivalency Course was recognized by the Government. Therefore, the second respondent has rightly rejected the application and in the prospectus, it is clearly mentioned that 10 + 2 + 3 regular stream as the prescribed qualification and nowhere it is mentioned in the prospectus that the aforesaid diploma Course is equivalent to the qualification prescribed for admission to 3 year L.L.B. Course. Therefore, this Court is of the view that the petitioner is not entitled to get any relief as prayed for in the writ petition.

3. At this stage, the petitioner prays to make an application before the Secretary to Higher Education, to consider Diploma in I.T. Course as equivalency Course to the qualification prescribed for 3 year L.L.B. Course.

4. In view of the request made by the petitioner, liberty is granted to the petitioner to make an application to the Secretary to Higher Education, Higher Education department within a period of two weeks from the date of receipt of copy of this order. On such application being received by the authority, same shall be considered and take appropriate decision at the earliest and copy of the said decision shall also be communicated to the petitioner.

5. The writ petition stands disposed of with the above directions. No costs.
