PETITION under Article 226 of The Constitution of India seeking to issue a Writ of Habeas Corpus directing the second respondent to produce the daughter of the petitioner Ragini, aged 19 years, who is detained illegally by the first respondent before this Court and set her at liberty.

ORDER

(Order of the Court was made by NOOTY.RAMAMOHANA RAO,J) This habeas corpus petition is instituted by one Maheswaran, S/O Jayaraman of Kannankottai Village, Gummidipoondi Taluk, Tiruvallur District for causing the production of his 19 year old daughter Ragini, who is allegedly detained by the first respondent, who was working as an Assistant Professor at RVS College, Matharpakkam, Gummidipoondi Taluk, Tiruvallur District. (2)

2. Pursuant to the notice issued by this Court on 10.5.2017, the Thiruvallur Police have acted very swiftly in the matter. It appears that the missing girl Ragini was traced at Coimbatore. https://hcservices.ecourts.gov.in/hcservices/

The Police have done a great job in tracing her and producing her in the court today. The parents of the missing girl are also present in court. They were not only identified by the learned counsel for the writ petitioner - father, but the local Police have also identified them as the residents of Kannankottai Village and as the parents of the missing girl Ragini.

3. We had also interacted with the missing girl Ragini in particular. Since she is very familiar with Telugu language, I had interacted with her in Telugu language for quite some time. We were given to understand that the girl has gone out to a friend's place on her own without informing the parents. The parents have mistaken her disappearance and instituted this case.

4. Be that as it may, since the missing girl has been traced and produced before us and as the detenue, having already passed 10 + 2 course, is pursuing first year teacher training course as well, we are satisfied that this case can be disposed of by allowing the parents of the girl to take her custody.
