ORDER : The Court Made the following order :- This is a petition for anticipatory bail. The petitioner on apprehending arrest at the hands of the respondent police has moved this petition seeking for anticipatory bail.
2.The alleged offence punishable for which, FIR was filed against the petitioner were under Sections 341, 294(b), 324 & 307 of IPC in Crime No.4 of 2017.
3. According to the respondent prosecution, the date of occurrence was 14.07.2017. Learned Additional Public Prosecutor would submit that the earlier anticipatory bail application in Crl.O.P.No.14904 of 2017 filed by this petitioner along with coaccused was dismissed by this Court on 28.07.2017. Subsequently, though other accused persons had filed such petitions three times and all the time those petitions were dismissed, this petitioner has come out with this petition only as a second time.
4. Learned counsel appearing for the petitioner submits that petitioner is a student studying in B.A. History II Year and he has to appear before the forth coming University examinations for which, he is preparing well. Therefore, he apprehends that, if the respondent police arrest the petitioner, after such a long time of the date of occurrence, that would hamper his studies and he would further submit that whatever condition to be imposed by this court, the petitioner would be abide by the order of this Court.
5. Considering the facts and circumstances of the case, this court is inclined to pass the following order: (i) That the petitioner in the event of arrest shall be enlarged on bail on condition that he shall execute a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand only) with two sureties each for a likesum to the satisfaction of the learned XVI Metropolitan Magistrate, George Town, Chennai, within a period of two weeks, from the date of receipt of a copy of this order:
(ii) The petitioner shall appear before the Investigating Officer once in a week for a period of four weeks and thereafter, as and when required for interrogation.
(iii) It is made clear that if the petitioner involved in any other unlawful activities during college hours or out of college hours, the same can be viewed seriously by the respondent police and whatever action can be taken in accordance with law shall be taken against him.
