Civil Revision Petition filed under Article 227 of the Constitution of India, to direct the District Munsif Court, Chengalpet to take the plaint in unnumbered plaint returned dated 18.2.2015 passed in O.S.S.R.No.2503 of 2015 on the file of learned District Munsif, Chengalpet. O R D E R
The plaintiffs in an unnumbered plaint in the suit in O.S.S.R.No.2503 of 2015 on the file of District Munsif Court, Chengalpet have filed the above Civil Revision Petition to direct the trial court to take on file the unnumbered plaint dated 18.2.2015 in O.S.S.R.No.2503 of 2015.
2. The District Munsif Court, Chengalpet returned the papers raising query with regard to the payment of court fee an also raising other queries. The plaintiffs, represented the papers on 17.2.2015 making an endorsement for the returns made by the trial court. Thereafter, the trial court, returned the papers again on 18.2.2015 for complying with the defects.
3. The learned counsel appearing for the petitioners submitted that the plaintiffs have not advanced any argument before the trial court so far with regard to the queries raised by the trail court.
4. In these circumstances, I grant liberty to the petitioners to advance their arguments before the trial court with regard to the queries raised by the trial court on 21.1.2015. If the trial court is satisfied after hearing the submissions of the learned counsel for the plaintiffs, if it deems fit, number the plaint, otherwise, the trial court is directed to pass suitable orders in the matter. The petitioners-plaintiffs are directed to make their submissions within one week from the date of receipt of copy of this order. With this observation, the Civil Revision Petition is disposed of. No costs.
