Prayer:- Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus directing the respondents 1 & 2 to implement the circular issued by 4th respondent IBA Lr.No.HR&IR/CIR/G2/BRK/4684 dated 16.03.2018, process the petitioner's application for pension and disburse the pension along with the arrears of pension with 10% interest to the petitioner.

ORDER

By consent, the writ petition is taken up for final disposal and is disposed of by this order.

The present writ petition is filed by the petitioner seeking for issuance of a writ of mandamus to implement the circular of the 4th respondent dated 16.03.2018 and to process the petitioner's application seeking for disbursement of pension along with arrears of pension with interest @ 10% per annum.

This Court heard the submissions made on either side and also perused the materials placed.

It is seen that a proposal to extend the option of pension for compulsorily retired officers/employees on certain terms and conditions, in tune with the Bipartite Settlement/Joint Note dated 27.04.2010 is under consideration and it is the submission of the learned counsel for the petitioner that the petitioner has submitted a representation dated 31.03.2021 seeking to opt for pension and the petitioner will be satisfied if a direction is given to the 1st respondent to consider the said representation and pass appropriate orders. 5.
The learned counsel appearing for the respondents/Bank would submit that he has no objection for issuing such a direction, if such direction is issued without deciding the issues on merits and to leave it open to the 1st respondent to take appropriate decision based on regulations as may be applicable in general to the Bank of Baroda.

Considering the grievance expressed by the petitioner and the submission made by the learned counsel for the respondents/Bank, this Court, without expressing anything on merits of the petitioner's representation and the stand taken by the learned counsel on either side, directs the 1st respondent to consider and dispose of the representation of the petitioner dated 31.03.2021 on merits and in accordance with law and pass appropriate orders, having regard to the Regulations or decisions which are applicable to the Bank, within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner herein.

The writ petition stands disposed of accordingly. No costs.
