Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the 1st respondent to survey the petitioner's NANJA land properties situated at Tindivanam Registration District, Marakanam Sub-registration District, Panchayat Union, Nadukuppam Village Survey Nos.6/13 which is total extent of 0.43.5 ares acre 0.10 cents, as per old Survey No.47/5 agriculture land based the petitioner on line survey fee Challan No.20211208946878 dated 08.12.2021, consequently direct the 2nd respondent to provide adequate police protection on the date and time of land survey by the 1st respondent.

This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to act upon the online application submitted by the petitioner on 08.12.2021 and to conduct survey in the subject property and demarcate the boundaries.
2. Heard Mr.T.V.G.Kartheeban, learned counsel for petitioner, Mr.R.P.Murugan Raja, learned Government Advocate appearing for first respondent and Mr.V.J.Priyadarsana, learned Government Advocate [Crl.side] appearing for second respondent.
3. The petitioner is relying upon the sale deed dated 15.09.2016. The petitioner is also relying upon the patta issued in Patta No.3086 with respect to the subject property. The petitioner submitted application seeking for survey in the year 2021 and since there was some resistance, police protection was also sought for. Since the same was not 2/4
acted upon, the present writ petition has been filed before this Court seeking for appropriate direction.

Taking into consideration the facts and circumstances of the case, there shall be a direction to the first respondent to act upon the application submitted by the petitioner on 08.12.2021 and conduct survey in the subject property based on the title document and the patta that stands in the name of the petitioner. This process shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order. If there are any rival claims, such survey shall be conducted in their presence. If there is any resistance, which may give rise to law and order problem, the second respondent shall provide police protection. This writ petition is disposed of with the above direction. No costs.
