2. This is an application for condonation of delay of 86 days in filing the appeal papers.
3. Learned counsel for the respondent prays for time on the ground that appeal papers have not been served and therefore, seeks to file counter. Let a copy of the appeal papers be served on the learned counsel for the respondent during the course of the day.
4. On going through the reasons stated in the application and taking into consideration the short period of delay, we are inclined to condone the delay.
5. Accordingly, the delay is condoned and the application is allowed.
