CMP.No.11188 of 2018 has been filed to condone the delay of 1040 days in seeking to set aside the abatement caused by the death of second respondent viz., Krishmanoorthy in S.A.No.668 of 2012; CMP.No.11189 of 2018 has been filed to set aside the abatement caused by the death of the second respondent viz., Krishmanoorthy in S.A.No.668 of 2012; CMP.No.11190 of 2018 has been filed to bring on record the respondents 7 to 10 herein as the legal representatives of the deceased second respondent and rank them as the respondent Nos. 7 to 10 in S.A.No.668 of 2012.

2.The factum of the death of the second respondent and the proposed respondents 7 to 10 are the legal representatives of the deceased, are not in dispute.

3.Having been satisfied with the reasons stated in the affidavit filed in support of these petitions, these petitions are allowed. 4.The Registry is directed to amend the cause title within a period of two weeks and post the matter after three weeks. 5.R3 reported dead, particulars to be furnished to the learned counsel for the appellant.
