ORDER

(Order of the Court was made by S.M.Subramaniam J.) This petition has been filed to condone the delay of 423 days in filing the above appeal.

2. The learned counsel for the petitioner would submit that the petitioner is a senior citizen aged about 66 years and therefore he was not in a position to make arrangements to file the appeal within the time limit. The delay is neither wilful nor wanton.

3. The learned counsel for the respondents would oppose the petition stating that the reasons stated would be insufficient.

4. Considering the fact that the petitioner is a senior citizen and it is an Original Side Appeal, this Court is inclined to consider the petition by imposing a costs of Rs.5,000/- payable to the State Legal Services Authority. The petitioner shall pay the said cost amount within a period of one (1) week from today.
