ORDER

This petition is filed to call for records relating to the FIR in Crime No.35 of 2013 on the file of the Inspector of Police, Central Crime Branch, Team II, Land Grabbing Unit.II, Veppery, Chennai600 007 and quash the same in so far as it relates to the petitioner herein.

2. The petitioner is the sixth accused in F.I.R in Crime No.35 of 2013 which is under challenge in the present petition in Crl.O.P.No.2223 of 2016. Earlier, except the petitioner/A6 herein, the other accused namely A1 to A5 filed a petition in Crl.O.P.No.26888 of 2016 to quash the said F.I.R in Crime No.35 of 2013. When the said petition was pending, the defacto complainant and other accused persons namely A1 to A5 have amicably resolved the issue among themselves and accordingly, the F.I.R in Crime No.35 of 2013 came to be quashed by this Court by an order dated 13.07.2017, in so far as Accused 1 to 5 are concerned. Now, the petitioner/A6 has filed the present petition in Crl.O.P.No.2223 of 2016 to quash the said F.I.R as against him.

3. Since, the matter has already been amicably resolved between the defacto complainant and the main accused, I am of the opinion that the present petition is also liable to be allowed. Accordingly, the petition is allowed and the F.I.R in Crime No.35 of 2013 is quashed as against the petitioner herein.
