These applications have been filed to condone the delay of 23 days in filing the written statement and to condone the delay of 141 days in filing the adoption memo adopting the written statement filed by the 1st defendant in C.S.No.222 of 2023.

2. In the affidavit filed in support of these applications, the first defendant had stated that he returned back to Kerala for personal commitments and was not able to contact the learned counsel for giving instructions to file a written statement. Hence there was a delay of 23 days in filing the written statement. Only if the written statement is filed, the adoption memo can be filed by the other defendant.

3. Taking into consideration the reasons advanced in the affidavit filed in support of these applications and also on hearing the learned counsel for the plaintiff, the delay is condoned and these applications are allowed. 03.07.2024 gsk https://www.mhc.tn.gov.in/judis
