Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Certiorari, calling for the records pertaining to the order dated 13/ 12 / 2022 passed by the Presiding officer, Labour Court, Kancheepuram in I.A. No.1 of 2022 in C.P. No.169 of 2018 and quash the same.

O R D E R

The writ petition is filed for the following relief: "Calling for the records pertaining to the order dated 13/ 12 / 2022 passed by the Presiding officer, Labour Court, Kancheepuram in I.A. No.1 of 2022 in C.P. No.169 of 2018 and quash the same".

2. As per calculation of the petitioner management a sum of Rs.4,53,844/- is due to the respondent which is also admitted by the learned counsel for the respondent.

3. It is also brought to the notice of this Court that the following amounts have been deposited into the Labour Court: 2/7

Sl.No Description Amount Management deposited amount in the file of the Labour Court as awarded in EA.No.01 of 2022 in EP.No.3 of 2020 in CP.No.169 of 2018 dated 10.08.2022 due to avoid bus attachment.

Rs.4,59,463/- Awarded to deposit 25% of the amount noted in EP (IOB DD.No.658262, dated 06.10.2022) Management deposited amount in the file of the Labour Court as ordered in interim stay order by WMP.No.9954 of 2023 in WP.No.9898 of 2023.

Rs.4,59,000/- Ordered to deposit further Rs.4,59,000/- (IOB DD.No.925087, dated 28.04.2023) Total Rs.9,18,463/-

4. Considering the fact that the respondent is entitled to a sum of Rs.4,53,844/- towards back wages and taking into consideration the deposits made, the respondent is permitted to withdraw the amount i.e., Rs.4,59,463/-, deposited to the credit of the Labour Court in EA.No.1 3/7

of 2022 in EP.No.3 of 2020 in CP.No.169 of 2018 dated 10.08.2022. Though this amount is little above the amount that is due towards gross back wages considering the efflux of time the petitioner management is ready to pay the aforesaid sum.

5. The second deposit namely, a sum of Rs.4,59,000/- which has been deposited pursuant to the orders of this Court in WMP.No.9954 of 2023 in WP.No.9898 of 2023, shall be withdrawn by the petitioner / management.

6. It is needless to state that the petitioner shall endeavour to pay the arrears of salary, gratuity and all other amounts that are due and payable to the respondent, within a period of 2 months from the date of receipt of a copy of this order.

7. The Writ Petition is disposed of with the above directions. 4/7

Consequently, the connected miscellaneous petition is closed. No costs.
