PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India praying to set aside the fair and decreetal order of the learned Additional Sub Judge, Namakkal passed in I.A.No.1 of 2019 in O.S.No.82 of 2012 on 25.01.2019.
For Petitioner : Mr. S. Muthukrishnan
O R D E R
The above Civil Revision Petition is filed challenging the order passed by the learned Additional Subordinate Judge, Namakkal in I.A.No.1 of 2019 in O.S.No.82 of 2012, which is an application moved by the defendant after the evidence on the plaintiff's side has been completed and the matter was listed for cross examination, to produce CCTV footage recorded at the office of the plaintiff for http://www.judis.nic.in
P.T.ASHA, J., mrn proving that the plaintiff knew one Senthil. In the original written statement that has been filed, there is no reference to the said Senthil and now the application is moved with a new fact that the plaintiff had denied knowledge about the said Senthil. The defendant has to prove the case that he has not executed the promissory note or that he has not received consideration independently. The CCTV footage is not going to either advance or retrograde his case. I do not find any infirmity in the order passed in the Trial Court. The Civil Revision Petition is dismissed. Consequently, connected Miscellaneous Petition is closed.
