Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, to direct the respondents 4 and 5 to consider the petitioner's representations dated 27.12.2024 & 18.02.2025 and disburse the fair wage salary arrears for the period 01.04.2012 to 01.03.2016 and gratuity with interest at the rate of 9% to the petitioner within the period stipulated by this Court. ORDER

This Writ Petition has been filed by the petitioner seeking to direct the respondents 4 and 5 to consider the petitioner's representations dated 27.12.2024 & 18.02.2025 and disburse the fair wage salary arrears for the period 01.04.2012 to 01.03.2016 and gratuity with interest at the rate of 9% to the petitioner within the period stipulated by this Court.

2. Since no adverse order is being passed against the respondents, notice to the respondents is dispensed with.

3. The case of the petitioner is that, the petitioner was employed as an Electrical Supervisor in Oil & Natural Gas Corporation Ltd. (in Page No.2 of 6

short 'ONGC') from 1995 to 2025 through various contractors. Despite ONGC introducing a fair wage policy in 2012, the petitioner was not paid the enhanced wages. After retiring, the petitioner sought settlement of fair wages and gratuity, but received no response. The petitioner is entitled to difference in enhanced wages and gratuity, which should have been settled in 2016. However, the respondents have withheld the said amount for over 8 years. Seeking payment of enhanced fair wages and gratuity, the petitioner sent representations dated 27.12.2024 and 18.02.2025 to the respondents. However, the same was not considered. Hence, the present writ petition has been filed seeking the aforesaid relief.

Though very many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues a direction to the respondents 4 and 5 to consider the petitioner's representations dated 27.12.2024 and 18.02.2025 and pass appropriate orders, within a time frame that may be stipulated by this court.

5. Heard the learned counsel for the petitioner and perused the materials placed on record.

Considering the limited request made by the learned counsel for the petitioner, this court, without going into the merits of the case, directs the respondents 4 and 5 to consider the representations of the petitioner dated 27.12.2024 and 18.02.2025 on merits and in accordance with law and pass appropriate orders, within a period of eight (8) weeks from the date of receipt of a copy of this order, after affording an opportunity of personal hearing to the petitioner and aggrieved persons, if any.

7. With the above direction, this writ petition is disposed of. No costs.
