ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 449, 302, 395, 396 read with 397 of IPC in Crime No.39 of 2004 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused persons had committed an offence of 302 of IPC in the year 2014 abd was granted bail and thereafter, he was not appeared before the trial Court for hearing. Hence, the petitioner has been remanded to judicial custody in PRC. No.7 of 2020.

3. The learned counsel appearing for the petitioner submitted that the the petitioner along with other accused persons and the defacto complainant attacked with each other and both the parties were sustained injuries and one persons died. There is no motive for committing murder and prayed for grant of anticipatory bail.

4. The learned Additional Public Prosecutor submitted that there are two previous cases pending against this petitioner similar in nature. Therefore, he opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the allegations and the petitioner is habitual offender and there are two previous cases pending against him similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner.
