Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing respondent 3-5 to consider the petitioner's representations dated 21.11.2025 and 23.02.2026 objecting to the proposed grant of quarry lease in respect of S.F.Nos.961 and 974 of Manakadavu Village Dharapuram Taluk Tiruppur District.

ORDER
(Order of the Court was made by the Hon'ble Chief Justice) None appeared for the petitioner when the petition was taken up for hearing on 07.04.2026. It was passed over in the first round. None appeared for the petitioner even in the second round. Even today, there is no representation for the petitioner.
2. Challenge in this writ petition is to the grant of quarry lease in respect of S.F.Nos.961 and 974 of Manakadavu Village, Dharapuram, Tiruppur District.
3. The major averments raised in the writ petition is that the proposed quarry is situated within a radius of 150 meters from residential houses of Pachapalayam Village and it is within a short distance from the Government Primary School and anganwadi centre; where more than 30 children are presently studying. There is also
village temple located nearby, where regular public worship is conducted. The village abuts a State highway, which lies within the same 150 meter zone and there always exits continuous vehicular movement, including school buses, public transport vehicles and goods carriers. According to the petitioner, the Government should reconsider grant of quarry lease in such a busy locality.
4. Per contra, learned Additional Advocate General submitted that tender has already been awarded on 04.03.2026 and the successful bidder has also deposited the entire bid amount.
5. We find that barring bald allegations that the proposed quarry falls within 300 meters of the inhabited and residential areas, no shred of material is placed to substantiate the claim. In the absence of any material supporting the averments, this Court cannot construe that all that has been stated in the affidavit is gospel truth.
6. That apart, it is clear from the submission of the learned Additional Advocate General that the tender has already been awarded and third party interest has also been created. Therefore, we are not inclined to entertain the writ petition. However, the petitioner would be
at liberty to avail remedy in accordance with law, if so advised.
