C.M.P.No.8703 of 2021 in S.A.No.SR54621 of 2014 P.T.ASHA, J., The learned counsel for the petitioner would submit that the 3rd respondent has left the village nearly 7 years ago and his whereabouts are not known and they are also not aware as to whether he is dead or alive and he is a bachelor. The other respondents have been served but have not entered appearance.

2. The above petition is filed to condone the delay of 1498 days in filing the application to set aside the order of dismissal dated 28.01.2016.

3. Sufficient reasons have been given in paragraph nos.3 to 6 of the affidavit filed in support of the petition. Hence, the delay is condoned.
