ORDER
The present petition is filed to set aside the order of dismissal for default dated 11.03.2019 and restore the W.P.No.15772 of 2018 on the file of this Court.
2. The petitioner in W.P.No.15772 of 2018, was 58 years old at the time of filing of the writ petition, sought a direction from this Court directing the respondents to permit her to continue in service until she attained the age of 60 years. The writ petition was dismissed for non-prosecution. Thereafter, the present petition in W.M.P.No.11474 of 2019 was filed for restoring the writ petition i.e., W.P.No.15772 of 2018.
3. As seen from the prayer of the Writ Petition in W.P.No.15772 of 2018, the petitioner sought directions to continue in service until she attained the age of 60 years. As she must be aged around 65 years by now, the relief sought in the writ petition has become infructuous, and the cause for its restoration no longer survives.
4. However, the learned counsel for the petitioner submitted that liberty may be granted to the petitioner to file a writ petition seeking pensionary benefits.
5. Considering the facts and circumstances of the case, the petitioner is granted liberty to file a fresh writ petition seeking pensionary benefits.
