O R D E R

The petitioner, who was arrested and remanded to judicial custody on 19.03.2020 for the offence punishable under Sections 307, 427, 506(ii) of IPC in Crime No.430 of 2020 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 18.03.2020, the petitioner and other accused persons consumed liquor and there was a wordy quarrel between them. Suddenly, one of the accused attacked the defacto complainant with knife and ran away from the place of occurrence. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is not involved in the above alleged offence and he is no way connected with the offence as alleged by the prosecution and he did not commit any offence. Further he would submit that the petitioner is in judicial custody from 19.03.2020 and hence, he seeks bail for the petitioner.

4. The learned Additional Public Prosecutor would submit that the petitioner and other accused persons consumed liquor and attacked the defacto complainant and his friend with knife and thereby they sustained grievous injuries. He would also submit that the petitioner is a habitual offender and had three previous cases pending against him. in Crl.M.P.No.1230 of 2020 dated 20.04.2020 was dismissed on the file of the Principal District and Sessions Judge, Coimbatore. Hence, he vehemently opposed for grant of bail to the petitioner.

Considering the above facts and circumstances, the petitioner had committed very grave offence and had bad antecedents and also involved in three previous cases, therefore this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original petition is dismissed. -sd/- 12/05/2020 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
