O R D E R

The petitioner, who was arrested and remanded to judicial custody on 03.05.2020 for the offence punishable under Sections 341, 394, 397 and 506(ii) of IPCin Crime No.556 of 2020 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 03.05.2020, when the defacto complainant and his friend went to medical shop for purchase of medicines. At that time the accused person way laid them at knife point and demanded money and cell phone. Thereafter, the petitioner robbed a sum of Rs.2,000/- from the defacto complainant and a cell phone from his pocket. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is not involved in the above alleged offence and he is no way connected with the offence as alleged by the prosecution and he did not commit any offence. Further he would submit that the petitioner is in judicial custody from 03.05.2020 and hence, he seeks bail for the petitioner.

4. The learned Additional Public Prosecutor would submit that the petitioner way laid the defacto complainant at knife point and robbed a sum of Rs.2,000/- and a cell phone. He would also submit that the petitioner is a habitual offender and had seven previous cases pending against him similar in nature. Hence, he vehemently opposed for grant of bail to the petitioner.

5. In the light of the above submissions made by the learned Additional Public prosecutor, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original petition is dismissed.
