ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 8(c), 20(b)(ii)(B), 25 and 25(1) of BNS in Crime No.690 of 2025, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner, along with other accused, was found to be in illegal possession of 35 kgs of ganja. Hence, the complaint.
3.The learned counsel for the petitioner would submit that no recovery has been made from the petitioner and that he has been implicated in the case solely on the basis of the confession statement given by the co-accused. Hence, the petitioner seeks anticipatory bail.
4.However, the learned Government Advocate (Criminal Side) would strongly oppose the bail application on the ground that the case involves a commercial quantity of 35 kgs of ganja.
5.Considering the gravity and nature of the allegations, this Court is of the firm view that, in cases involving narcotic drugs, particularly where a commercial quantity is involved, when bail itself has to pass the test under section 37 of NDPS Act does not arise.
6. In view of the above factual position, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
