ORDER

This Criminal Original Petition has been filed to quash the impugned summon dated 06.03.2025 in CSR/3/2025 dated 08.01.2025, C.No.67/AC MDPM/2025 dated 18.02.2025 issued by 1st respondent.

2. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.side) for the first respondent and perused the materials placed on record.

3. The third petitioner is the wife of second petitioner and the second and third petitioners are in-laws of second respondent. Due to family dispute, the second respondent lodged a complaint. On receipt of the same, the first respondent issued summons to the petitioners. In fact, the petitioners filed a petition in Crl.O.P.No.5134 of 2025 directing the first respondent not to harass the petitioners under the guise of enquiry. This Court, by an order dated 25.02.2025 issued directions to be followed while conducting enquiry by issuance of summons. Accordingly, the petitioners were issued summons to appear for enquiry before the first respondent and they had appeared before the first respondent. Once again, the petitioners were issued with summon dated 06.03.2025 for the third time, thereby directing the petitioners to appear for enquiry to be held on 10.03.2025. On 10.03.2025 also the petitioners appeared

for enquiry.

4. Therefore, the first respondent is directed not to call the petitioners repeatedly under the guise of enquiry. Further, if there is any cognizable offence made out on the complaint lodged by the second respondent, the first respondent is at liberty to register FIR or close the complaint, within a period of two weeks from the date of receipt of a copy of this order. Further, the impugned summon in this petition become infructuous, since the petitioners had appeared before the first respondent already on 10.03.2025.
