S.P.Appearels Limited v. State Of Tamil Nadu,
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 18.8.2017
CORAM:
THE HONOURABLE MR. JUSTICE K.K.SASIDHARAN Review Application No.28 of 2017 Lakshmi Sudersan : petitioner versus Pavadai Samy : respondent Petition filed to review the order passed in C.R.P.(PD) No.1207 of 2016 dated 2.12.2016.
For petitioner : Mr.S.Kadarkarai
O R D E R
This review application seeks review of the common order dated 1 December 2016 in C.R.P.(PD) Nos.1207 and 1208 of 2016 dismissing the civil revision petitions, by confirming the order passed by the Trial Court.
2. The common order passed by the learned Addl. District Munsif, Chidambaram, dated 22.9.2015 in I.A.Nos.545/2013 and 576/2014 was challenged before this Court primarily on the ground that the subsequent suit is barred by res judicata, on account of the finding recorded in the earlier suit in O.S.No.135/2005. This Court answered the said issue in paragraph 13 of the order by observing that the earlier suit was a simple suit for injunction and there was no pleading with respect to title. http://www.judis.nic.in

3. The petitioner in the present review application has raised the very same grounds, probably for the purpose of re-arguing the very revision petitions. The scope of an application to exercise the review jurisdiction under Order 47 Rule (1) of the Code of Civil Procedure is very limited. It would not be permissible to re-appreciate the reasons once again under the guise of review. I am therefore of the view that the petitioner has not made out a case for review of the earlier order in the respective revision petitions.
4. In the upshot, I dismiss the review application. No costs. 18.8.2017 tar Review Appl No.28 of 2017 http://www.judis.nic.in
