ORDER
The writ petition has been filed for the following relief: "directing the respondents to approve petitioner's appointment as Gardener in the sanctioned death vacancy of Mr.Yazer Arafath in the 4th respondent college w.e.f.1.7.2024 on compassionate grounds in accordance with law, within a time frame."
2.It is the case of the petitioner that she is the wife of the late Mr.Yaser Arafath, who was employed as a Gardener in the 4th respondent college. The petitioner's husband died in harness on 07.10.2023, leaving behind the petitioner and daughter.
2.1.Due to financial hardship, she submitted an application for compassionate appointment to the 4th respondent along with the necessary documents. After verification, the 4th respondent appointed the petitioner as Gardener on compassionate grounds on 01.07.2024 and forwarded the proposal to the 3rd respondent for approval. The 3rd respondent, by a communication dated 26.07.2024, stated that the competent authority for approval is the 2nd respondent. Thereafter, the proposal was forwarded to the 2nd respondent on 28.10.2024. However, there is no response till date, aggrieved by which, the
petitioner is before this Court.
3.Heard the learned counsel on either side and perused the materials available on record.
4.Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the second respondent to consider the petitioner's application, on merits and in accordance with law and to pass appropriate orders, within a period of six weeks from the date of receipt of a copy of this order.
