JUDGMENT

(1)Earlier, when the matter was listed on 02.12.2021, there was no representation on behalf of the appellant and however, at the request of the learned Additional Government Pleader appearing for the 1st respondent, the matter was directed to be listed on 10.12.2021.

(2)Again when the matter was taken up for hearing on 10.12.2021, there was no representation on behalf of the appellant. This Court, observing that the appellant is not interested in prosecuting the appeal, directed the Registry to list the matter under the caption ''for dismissal''.

(3)Even today, when the matter is called, there is no representation for the appellant. This Court is left with no https://hcservices.ecourts.gov.in/hcservices/

other option except to dismiss the appeal suit for non prosecution.

(4)In the result, the Appeal Suit is dismissed for non prosecution. No costs.
