This petition has been filed seeking to vacate the stay granted on 25.08.2022 in W.M.P.No.21321 of 2022 in W.P.No.22285 of 2022 till the disposal of the writ petition.
2.The learned counsel appearing for the petitioners submitted that settlement deed was executed in favour of the first respondent/ son of the petitioners and thereafter since the first respondent did not maintain the petitioners, the petitioners filed petition before the third respondent/The Revenue Divisional Officer under the Maintenance and Welfare of Parents and Senior Citizen Act, seeking cancellation of the settlement deed and the same was allowed by the third respondent on 14.07.2022. The said order was challenged by the first respondent before this Court in the writ petition and this Court vide order dated 25.08.2022 granted an order of interim stay. 3.The learned counsel appearing for the petitioners further submitted that the first respondent is not maintaining the petitioners 1/2 https://www.mhc.tn.gov.in/judis

pri and the petitioners need proper maintenance from their son/ first respondent and hence, the petitioners have filed this petition seeking to vacate the order of interim stay granted by this Court. 4.Considering the submission made by the learned counsel appearing for the petitioners, this Court directs the first respondent to pay a sum of Rs.40,000/- (Rupees Forty Thousand Only) (Rs.20,000/- each) to the petitioners, on or before 5th of every succeeding English Calender Month, towards maintenance. 5.This miscellaneous petition is ordered on the above terms. 12.06.2023 pri Note: Registry is directed to list the writ petition on 27.06.2023.
