At the instance of the learned counsel for the petitioners the matter has been listed under the caption 'for being mentioned'. 2.Mr.V.Chandrakanthan, learned counsel for the petitioners submitted that in paragraph nos.2 & 4, it has been mentioned as though the respondent/defendant has filed his counter affidavit. But on verification, he found that the respondent/defendant has not filed his counter affidavit. 3.Taking into consideration the submission made by the learned counsel for the petitioners, the following order is passed: a)in paragraph no.2 of the order dated 21.04.2015 instead of "the respondent also filed his counter affidavit and is contesting the suit", it should be mentioned as "the respondent has not filed his counter affidavit so far."

b)in paragraph no.4 instead of "the respondent/ defendant has already filed his counter affidavit", it should be mentioned as "the respondent/defendant, so far, has not filed his counter affidavit".

va 4.Having regard to the submissions made by the learned counsel for the petitioners, I direct the Registry to carry out the corrections in the order dated 21.04.2015 and issue a fresh copy of the order to the learned counsel for the petitioners on an application being made by him. In other aspects, the order dated 21.04.2015 shall remain unaltered. va 23.04.2015 Note: Issue order copy on 23.04.2015.
