ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus directing the respondent to grant promotion to the petitioner for the post of junior Engineer with all consequential benefits based on the circular dated 19.02.2024 issued by the respondent vide Po.Thu. Na.Ka En.Ee 4 / 39869 / 2023 pursuant to the petitioners representation dated 12.03.2024.

The case of the petitioner is that on 19.02.2024, the first respondent issued a circular and published the name list for promotion to the post of Junior Engineer, in which, the petitioner's was placed at S.No.1. The said panel has been prepared by considering the seniority of service. Despite the petitioner's name being recommended the petitioner's name for promotion to the post of Junior Engineer, his name does not find place in the promotion order issued by the respondent on 11.03.2024. Hence, the petitioner submitted a detailed representation to the respondent on 12.03.2024 requesting them to give promotion to the post of Junior Engineer. However, the same has not been considered so far and the petitioner is due to retire from service on 31.03.2026. Hence, he is constrained to file the present Writ Petition.

3. Heard the learned counsel appearing for the petitioner as well as the learned counsel appearing for the respondent.

Considering the limited prayer sought for by the petitioner and without going into the merits of the case, this Court directs the respondent to consider the petitioner's representation dated 12.03.2024 and pass an appropriate order, on merits and in accordance with law, after affording him an opportunity of personal hearing, within a period of six (6) weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
