Defendant Prayer : Civil Suit filed under Order IV Rule 1 of Madras High Court Original Side Rules read with Order VII Rule 1 of CPC to pray for judgment and decree against the defendant as follows:- a) to direct the defendant to pay to the plaintiff a sum of Rs.1,12,32,000/- (Rupees One Crore Twelve Lakhs and Thirty Two Thousand) and future interest @ 18% pa on Rs.60,00,000/- (Rupees Sixty Lakhs Only) from the date of plaint till the date of realization.

b) to direct the defendant to pay to the plaintiff the cost of the Suit.

c) for such other relief or reliefs as this Court may deem fit and proper.

J U D G M E N T

A memo had been filed indicating that pursuant to the joint memo of compromise dated 29.08.2024 between the parties the defendant also paid the Principal amount of Rs.60,00,000/- to the plaintiff, which has also been acknowledged in the memo filed by the learned counsel appearing for the plaintiff and hence, seeks permission of this Court to withdraw the Suit.

2. In view of the issue being settled between the parties, the plaintiff is permitted to withdraw the Suit. Registry is directed to refund the Court fee in the name of the plaintiff. Accordingly, the Suit is dismissed as withdrawn. 28.02.2025 Index : Yes / No Internet :Yes / No Gba 2/3
