The petitioner, who apprehends arrest for the alleged offence under Sections 303(2) and 326(a) of the Bharatiya Nyaya Sanhita (BNS), 2023 in Crime No.18 of 2026, on the file of the respondent police seeks anticipatory bail.
2. The case of the prosecution is that the petitioner was found to be in 1/4
illegal transportation of one unit of river sand without any valid permit or licence. Hence, the case.
3. There is no representation on behalf of the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and, upon instructions, submitted that the petitioner has got fifteen previous criminal antecedents. Hence, he strongly opposed to grant anticipatory bail to the petitioner.
5. Heard the submissions made by the learned Government Advocate (Crl.Side) for the respondent.
6. From the submissions made by the learned Government Advocate (Crl.Side), it is amply clear that whenever this Court granted liberty to the petitioner, he misused the same by committing similar offence. Therefore, it is not desirable to enlarge the petitioner on anticipatory bail.
