ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2) of BNS in Crime No. 9 of 2026, on the file of the respondent Police, seeks anticipatory bail.

2. The allegations against the petitioner is that the petitioner is ranked as A2 in this case and he joining hands with other accused, while stealing the Royal Enfield Bike, they have witnessed by passersby. Al in this case had caught red handed, however, the petitioner had run away from the scene of an occurrence, which led to the registration of an FIR. Hence, the present case.

3. The learned counsel appearing for the petitioner submitted that this is the second anticipatory bail petition and the earlier petition was dismissed by this Court in Crl.O.P.No.2761 of 2026 dated 06.02.2026; and that the petitioner has been implicated in this case, only based on the confession of Al. He further submitted that he has not involved in any offence and hence, he prayed to grant anticipatory bail to the petitioner.

The learned Government Advocate (Criminal side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner herein has been escaped from the scene of an occurrence at the time of stealing. He further submitted that the petitioner is also having four previous case of similar nature. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the nature and gravity of the offence and the fact that though the co-accused has already been released on bail, the petitioner has 4

previous cases of a similar nature, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly, this Criminal Original Petition stands dismissed.
